The Terms and Conditions for Being a Tutor

 

Terms and Conditions for Tutors

1. These terms and conditions are made between John Stanley Bridge trading as "The Educators" (hereinafter called "The Educators") of the one part and the tutor (hereinafter called "the Tutor") named overleaf of the other part.

2. These terms and conditions shall constitute an agreement for the supply of services by the Tutor to the Educators or the latter's clients and shall be deemed to have been accepted by the Tutor upon acceptance of the first assignment by the Tutor via The Educators.

3. The duration of this agreement shall be twelve calendar months from the date of acceptance of the Tutor by The Educators unless renewed or terminated before that date in accordance with the provisions hereof.

4. During the period of this agreement The Educators will use their best endeavours to circulate details of the Tutor to their clients (hereinafter called "the Client") of the purpose of introducing the Tutor to the Client for the purposes of Tuition of the Client or their children.

5. At all times the Tutor shall be deemed to be self-employed and shall be responsible for his or her own Income Tax and National Insurance Contributions and shall indemnify The Educators against any claim in respect thereof.

6. The Tutor shall be entitled to collect directly from the Client the charge of tuition rendered by the Tutor (hereinafter called "the Tuition Fee ") .and the commission due to The Educators

The Rate of Charge per hour of Tuition shall be in the charge band specified by The Educators from time to time (hereinafter called "the Authorised Charge Band").

7. The Tutor shall collect for The Educators a sum representing the percentage set out in the table below of the total Tuition Fees charged to Clients.

Secondary School

or Adult and above 25% of Total Tuition Fee

8. The Tutor shall provide the Client with a prepared contract showing

(a) The Tuition Fee due to the Tutor

(b) The commission due to The Educators

(c) Travelling Expenses due to the Tutor

9. The contract shall be in triplicate and signed by the Tutor and the Client

One copy is to be retained by the Client, the second by the Tutors and the third posted to The Educators

10 Any breach of that contract shall be notified in writing to The Educators

11. At the end of each calendar month the Tutor shall give a return of tuition hours and fees collected for The Educators on the prescribed form (hereinafter called "the Tuition Return") such form to be received together with a remittance in respect of the Commission Due (thereinafter called "the Commission Remittance") as calculated above within 5 days of the end of any month.

12. If the Tutor shall during the period of this agreement undertake any work or tuition on behalf of any Client of The Educators or on behalf of any person introduced to the Tutor by any existing or previous Client of The Educators the Tutor shall collect for The Educators the Commission Due in accordance with the foregoing provisions of this agreement.

13. The Tutor shall not for a period of two years from the expiry of this agreement within a radius as the crow flies of five miles from The Educators' place of business then current at the date

of termination either alone or in partnership or as agent shareholder or employee be concerned or connected with the running of any tuition agency whose business shall compete with that operated or carried on by The Educators.

14. This agreement may be terminated:-

(a) By the Tutor giving not less than one clear calendar month's notice in writing to The Educators, or

(b) By The Educators giving to the Tutor not less than one month's notice in writing except in the case of the occurrence of one or more the Specified Events set out in clause 12 in which case summary immediate termination shall be reasonable

15. The Specified Events shall mean any of the following:-

(a) Gross misconduct in the course of Tuition duties.

(b) Failure without reasonable excuse to attend for Tuition at the prearranged date and time.

(c) Failure to submit any Tuition Return within the time limit designated.

(d )Failure to submit any Commission Remittance within the time limit designated.

(e) Failure to disclose on the Tuition Return Tuition Fees received from any Client or from any person introduced by any Client.

(f) Failure to accurately return details of exact tuition hours or rates charged in any Tuition Return.

(g) Failure to adhere to charging rates within the Authorised Charge Band.

16 .Any notice given by either party terminating this agreement shall operate without prejudice to any existing liabilities of the Tutor to The Educators in respect of outstanding commission due.
